FourthIR Learning Instructor Terms

Welcome to FourthIR Learning! By becoming an instructor on our platform, you agree to adhere to the following Instructor Terms (“Terms”). These Terms govern your responsibilities and interactions as an instructor on FourthIR Learning and are an integral part of our broader Terms of Use, which outline the general conditions for using our Services. Any capitalized terms not defined in these Instructor Terms are as specified in the Terms of Use.
1. Instructor Obligations
As an instructor on FourthIR Learning, you assume responsibility for all content you post, including lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, labs, assessments, and announcements (“Submitted Content”).
You affirm that:
- You will provide and maintain accurate account information.
- You own or possess the necessary licenses, rights, consents, permissions, and authority to authorize FourthIR Learning to use your Submitted Content as outlined in these Terms and the Terms of Use.
- Your Submitted Content will not infringe or misappropriate any third party’s intellectual property rights.
- You possess the required qualifications, credentials, and expertise to teach and offer the services you provide through your Submitted Content.
- You commit to maintaining a service quality that aligns with industry standards and instructional best practices.
You also warrant that you will not:
- Post inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory, or libelous content.
- Engage in any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or other forms of solicitation.
- Use the Services for purposes other than providing tutoring, teaching, and instructional services to students.
- Interfere with or obstruct other instructors from delivering their services or content.
- Abuse FourthIR Learning resources, including support services.
2. License to FourthIR Learning
By submitting content, you grant FourthIR Learning the rights detailed in our Terms of Use to offer, market, and exploit your Submitted Content. This includes the right to modify Submitted Content for accessibility and sublicense these rights to third parties, including students and other entities.
You retain the right to remove your Submitted Content from the Services, and unless agreed otherwise, FourthIR Learning’s right to sublicense the content will terminate for new users 60 days after removal. Rights granted to students before removal will continue per the terms of those licenses.
We may use parts of your Submitted Content for quality control, marketing, promotion, demonstration, or operation of the Services. You also grant FourthIR Learning permission to use your name, likeness, voice, and image for related purposes.
3. Trust & Safety
3.1 Trust & Safety Policies
Instructors must comply with FourthIR Learning’s Trust & Safety policies, Restricted Topics policy, and other content quality standards. Approval for using our Services is at our sole discretion, and we reserve the right to remove content, suspend payouts, or ban instructors for various reasons outlined in these policies.
3.2 Co-Instructors and Teaching Assistants
The platform allows you to add co-instructors or teaching assistants for your Submitted Content. Compliance with our Co-Instructor Relationship Rules and Guidelines is mandatory, and violations by co-instructors may impact your account.
3.3 Relationship to Other Users
Instructors do not have a direct contractual relationship with students. Information about students received through the Services is for providing services on the FourthIR Learning platform only. You agree not to use student data for purposes other than delivering your services and not to solicit additional personal data.
3.4 Anti-Piracy Efforts
We partner with anti-piracy vendors to protect your content from unauthorized use. By using our Services, you appoint FourthIR Learning and anti-piracy vendors as agents to enforce copyrights for your content.
4. Pricing
4.1 Price Setting
When offering content for purchase, you set a base price for your Submitted Content. Participation in Promotional Programs may result in different prices. Currency conversion and pricing for mobile applications are outlined in detail.
You permit FourthIR Learning to share your content for free with employees, partners, and for restoring access to accounts.
4.2 Transaction Taxes
Transaction Taxes applicable to sales in certain countries will be collected and remitted by FourthIR Learning under applicable law. Pricing and taxes for mobile applications are handled by the mobile platform.
4.3 Promotional Programs
You can participate in optional marketing programs detailed in our Promotions Policy, enhancing your revenue potential on FourthIR Learning.
5. Payments
5.1 Revenue Share
Your revenue share is calculated based on the Net Amount after deductions. The default revenue share is 30%, subject to change with notice. Participation in Promotional Programs may alter the revenue share.
Instructor payments are made in USD, and you are responsible for any conversion fees.
5.2 Instructor Coupons and Course Referral Links
Coupon codes and referral links allow you to offer discounts to students. Revenue share for transactions using these codes is 97% of the Net Amount.
5.3 Receiving Payments
To receive timely payments, you must have a PayPal or Zambian Mobile Money account. You agree to provide necessary information and tax documentation for payment, with taxes withheld as applicable.
5.4 Refunds
Students have the right to refunds as per the Terms of Use. Instructors do not receive revenue from refunded transactions.
6. Trademarks
While you are a published instructor, you may use FourthIR Learning’s trademarks following provided guidelines, ensuring compliance and refraining from misleading use.
7. Deleting Your Account
Instructions for deleting your instructor account are available on our platform or can be gotten using the contact us form. Any remaining scheduled payments will be made before account deletion. Access to your Submitted Content by enrolled students may continue after account deletion.
8. Miscellaneous Legal Terms
8.1 Updating These Terms
These Terms may be updated periodically, and you will be notified of material changes. Continued use of our Services after changes become effective indicates your acceptance.
8.2 Translations
In case of conflicts, the English version of these Terms prevails over versions in other languages.
8.3 Relationship Between Us
No joint venture, partnership, employment, contractor, or agency relationship exists between you and FourthIR Learning.
8.4 Survival
Certain sections, including License to FourthIR Learning, Relationship to Other Users, Receiving Payments, Refunds, Deleting Your Account, and Miscellaneous Legal Terms, will survive the expiration or termination of these Terms.
